Licence terms
These terms are the agreement between the practice that subscribes (you) and the vendor of Loriini (we): Žofia Kosová, trading as Loriini.app, registered in the Czech Republic, IČO 19785283, DIČ CZ0154024321, postal address 212 Bondi Road 708, Bondi NSW 2026, Australia. Subscribing on the checkout page accepts them.
1. What is licensed
- Loriini is a program for Windows and an add-on for Archicad that make sun studies and related sheets from an Archicad project. We license it to you for your own architectural practice, on your own and your clients' projects, for as long as your subscription runs.
- The licence is counted in seats. A seat is a computer that has used Loriini in the last fourteen days. You may install Loriini on as many computers as you like; the number in use at once may not exceed the seats you pay for. Loriini tells you when one computer over is in use and stops a second.
- You may not sell, rent, sublicense or redistribute Loriini, offer it as a service to others, or remove the authorship and licence statements it displays and writes into its output. You may read its source, which is published, and may not reuse it beyond what these terms allow.
2. What the figures may be relied on for
- Loriini is a prototype and is not validated for submission. Its results are for design-stage iteration. They have not been validated against a reference implementation on a real project, and they must not be used as a compliance figure in a development application. A development application rests on a consultant's report. This clause stays until we publish that the validation is done.
- Loriini is a geometric sunlight-hours tool. It computes the sun's position from latitude, longitude and time and casts shadows from the model you give it. It is only as right as that model, its true north, and its site location, each of which every run echoes before any figure.
- The planning rules it assesses against are published with their citations, and may change after the version you run was made.
3. The subscription, and paying for it
- Subscriptions are monthly or yearly, per seat, in Australian dollars, at the price shown at checkout, and renew until cancelled. Payment is taken by Stripe. You can change the number of seats, your card, or cancel, in the customer portal; a cancelled subscription runs to the end of the period paid.
- A practice that pays annual invoices by bank transfer may ask for an invoice instead of the checkout; the licence then starts when the invoice is paid.
- If a payment fails, Loriini keeps working for fourteen days while the card is retried, and tells you so. After that it stops until the payment goes through.
- A fourteen-day trial key is free, needs no card, and ends by itself.
4. How the licence is kept, and what happens when things go wrong
- Each computer holds a signed licence key and renews a signed lease from our licence service, by itself, while it is used. A lease lasts fourteen days, so Loriini works for a fortnight with no connection, and a day our service is unreachable changes nothing.
- If your office's network cannot reach the service, we will issue an offline key for the period paid on request.
- If we find that a version gives a wrong result, we may withdraw it: Loriini will then say so and point to the current version. We will not withdraw a version without a current one to move to.
- If we stop offering Loriini for good, every current subscriber receives an offline key for the period paid.
- We may suspend a licence that is used beyond these terms, after telling you.
5. Support and updates
Updates during the subscription are included. Support is by email, at sami@loriini.app, on business days, as a small vendor can give it.
6. Privacy
What Loriini sends and what we keep is set out in the privacy note, which is part of these terms.
7. Liability
- Loriini is provided as it is. To the extent the law allows, we exclude all warranties not stated here, and our liability to you for anything arising from Loriini or these terms is limited to the subscription fees you paid in the twelve months before the claim.
- Nothing in these terms excludes guarantees that cannot be excluded under the Australian Consumer Law or other law that applies to you. Where a guarantee cannot be excluded but liability for it can be limited, our liability is limited to supplying the service again, or paying the cost of having it supplied again.
- We are not liable for a decision, a submission or a design made in reliance on a figure Loriini produced, which clause 2 says must not be relied on as a compliance figure.
8. Ending
You end the agreement by cancelling the subscription. We may end it if you breach these terms and do not put it right within fourteen days of being told. When it ends, the licence keys stop being renewed, and Loriini stops working beyond its free commands.
9. General
- These terms are governed by the law of the Czech Republic, and disputes go to its courts, without prejudice to rights you have under the law of your own country that cannot be taken away by agreement.
- We may change these terms for future subscription periods by publishing the new terms here and telling subscribers by email at least thirty days before they apply.
